1. Introduction and Acceptance
These Terms of Service (“Terms”) form a binding agreement between you and Otaku Quiz LLC, an Ohio limited liability company (“OtakuQuiz,” “we,” “us,” or “our”). They govern your access to and use of the OtakuQuiz mobile applications, websites, and related services (collectively, the “Service”).
By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. About OtakuQuiz
OtakuQuiz is an anime-themed trivia platform featuring questions across multiple anime titles, ranked leagues, daily challenges, leaderboards, and a Pro subscription tier.
3. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and 17, you represent that you have your parent or legal guardian's permission to use the Service, and that your parent or guardian agrees to these Terms on your behalf.
Content rated for mature audiences (“M-rated content”) is gated at 18 years of age. By accessing M-rated content, you represent that you are at least 18.
If you are under 13, please use OtakuQuiz Kids (com.otakuquiz.kids), our dedicated app for younger players, which requires verifiable parental consent.
4. Your Account
You may need to register an account to access certain features. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password and accept all risks of unauthorized access to your account.
- Notify us promptly if you suspect any unauthorized use of your account.
You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms.
5. The Service
The Service includes a quiz engine, anime title browser, leagues and progression system, daily challenges, leaderboards, and an optional Pro subscription. Features, content, and availability may change at our discretion.
We do not guarantee uninterrupted or error-free access. Scheduled maintenance, outages, or feature changes may occur.
6. OtakuQuiz Pro Subscription
6.1 Pricing and Plans
OtakuQuiz Pro is offered at:
- Monthly: $4.99 USD per month, billed monthly.
- Annual: $39.99 USD per year, billed annually (a discount versus monthly).
A free trial of 7 days is offered for new Pro subscribers. The trial converts automatically into a paid subscription at the end of the trial unless canceled before then.
6.2 Billing
Payments are processed by:
- Stripe, Inc. — for purchases made through our website.
- Apple, Inc. (App Store / In-App Purchase) — for purchases made through the iOS app.
- Google LLC (Google Play Billing) — for purchases made through the Android app.
We use RevenueCat, Inc. to manage subscription entitlements across these platforms. We do not store your full payment card information; payment processors handle that data subject to their own terms and policies.
6.3 Auto-Renewal and Cancellation
Pro subscriptions renew automatically at the end of each billing period at the then-current price unless canceled. You may cancel at any time:
- In-app: Settings → Subscription → Cancel.
- On iOS: through your Apple ID Subscriptions settings.
- On Android: through your Google Play Subscriptions settings.
- On the web: through your account billing page.
Cancellation takes effect at the end of the current paid period. You retain Pro features until the period ends.
6.4 Free Trial
We will notify you at least 48 hours before your free trial ends. You may cancel at any time during the trial without charge. Only one free trial per account.
7. Refund Policy
Subscription fees are generally non-refundable, except where required by applicable law.
European Union and United Kingdom users: If you are a consumer resident in the EU or UK, you have a statutory right to withdraw from a purchase within 14 days of the purchase date, without giving a reason. However, by starting use of digital content (including the Pro subscription) during the 14-day window, you expressly consent to immediate performance and acknowledge that you lose this right of withdrawal once performance has begun. If you have not yet started using Pro features, you may request a refund by emailing otakuquizllc@gmail.com.
For App Store and Google Play purchases, refund requests are handled by Apple or Google under their respective policies. We do not control or process those refund requests directly.
8. Acceptable Use
You agree not to:
- Use cheats, automation, scripts, bots, scrapers, or any unauthorized third-party tools to interact with the Service.
- Reverse-engineer, decompile, or attempt to extract source code or question data from the Service.
- Use the Service to harass, threaten, impersonate, or defame any person.
- Upload or transmit any content that is unlawful, infringing, harmful, or that violates the rights of others.
- Attempt to gain unauthorized access to any portion of the Service, other users' accounts, or our systems.
- Use the Service in any way that violates applicable laws or regulations.
- Create more than one account per person, or share accounts with others.
We may, at our discretion, suspend or terminate accounts that violate this section, void scores, remove leaderboard positions, or take other appropriate action.
9. User Content and Feedback
The Service does not currently support user-generated content uploads. If we add such features in the future, additional terms will apply.
If you submit any suggestions, feedback, ideas, or proposed improvements (“Feedback”) to us through any channel, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that Feedback into the Service or any other product, without compensation or attribution to you. You waive any moral rights in such Feedback to the extent permitted by law.
10. Intellectual Property
10.1 Our Content
The Service, including its software, design, layout, look-and-feel, original question text, original artwork, original graphics, logos, brand names (“OtakuQuiz”), and all other original materials, is owned by Otaku Quiz LLC and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.
10.2 Third-Party Content References
OtakuQuiz contains trivia questions that reference characters, plot points, and other elements of anime works owned by third parties. These references are made for the purpose of factual trivia and commentary, and are intended to constitute fair use under U.S. copyright law and analogous doctrines in other jurisdictions. All anime, manga, and related works referenced in the Service are the property of their respective owners. We make no claim of ownership over those works.
10.3 Intellectual Property Concerns
If you are a rights holder and believe that content in the Service infringes your intellectual property rights, please contact us at otakuquizllc@gmail.com with:
- Identification of the work you claim is infringed.
- Identification of the specific question, image, or content in the Service that you claim infringes.
- Your contact information.
- A statement that you have a good-faith belief that the use is not authorized.
- A statement that the information is accurate and (under penalty of perjury) that you are authorized to act on behalf of the rights holder.
We will review and respond in a reasonable timeframe, and may remove or modify content if we determine action is appropriate.
11. Third-Party Services and Links
The Service relies on third-party providers including, without limitation: Supabase Inc. (database and authentication), Vercel Inc. (hosting), Stripe Inc., Apple Inc., Google LLC, RevenueCat Inc. (payment and subscription processing), Google Analytics (analytics), and ad networks including Google AdMob and Google AdSense (advertising for non-Pro users). Your use of these providers is subject to their own terms and privacy policies.
We are not responsible for the content, policies, or practices of any third-party services or websites linked from the Service.
12. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or harmful components, or that trivia content is entirely accurate.
Some jurisdictions do not allow disclaimer of implied warranties. In those jurisdictions, the above disclaimer applies only to the maximum extent permitted by law.
13. Limitation of Liability
To the fullest extent permitted by law, Otaku Quiz LLC and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.
Our aggregate liability for any claim arising out of these Terms or your use of the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD $100.
Some jurisdictions do not allow exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
14. Indemnification
You agree to defend, indemnify, and hold harmless Otaku Quiz LLC and its officers, directors, employees, and affiliates from and against any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your use of the Service, or your violation of any rights of a third party.
15. Termination
You may stop using the Service at any time. You may delete your account through the in-app settings.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including without limitation if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately.
Sections that by their nature should survive termination (including without limitation sections on intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws principles. Any dispute arising under or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Ohio, and you consent to personal jurisdiction in those courts.
Nothing in this section limits any non-waivable consumer rights you may have under the laws of your country of residence.
17. Miscellaneous
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
No Third-Party Beneficiaries: These Terms create no third-party beneficiary rights.
Force Majeure: We are not liable for any delay or failure caused by events beyond our reasonable control.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Continued use of the Service after the effective date of the updated Terms constitutes acceptance of the changes.
